Definition of easement: an interest held by someone else in another person's property.

I guess the Rounder in this song had an easement on this guy's 'ol lady!

I never though about an easement in this sense before.

I always thought of an easement as a 'right of way'

An easement is a specific interest someone has in another person's property, but the property owner owns the land. Only the person with whom the interest lies can use the land, and only for the intended use. (i.e. if I have an access easement across your property to get to my home, I can't stop and have a picnic there. The easement is for ingress and egress only.)

A right-of-way is usually something that has been acquired from someone for a specific use (private or public) or dedicated by legislative or platting regulations. Typical r.o.w.'s are acquired or dedicated for roads and railroads, and can be created along trails that were used historically for economic use (i.e. RS2477 trails.)

What can be confusing sometimes is that easements can be right-of-ways when they are dedicated for public use.

Public utility easements are not open to the general public for thoroughfare.

The name of the song is really starting to tie in here. Natural born easement on the road again...

Cool - thanks for clarification - I'm sure it will give the song whole new meaning in my head next time I hear it.

this was how I was thinking of it:

" an interest in land owned by another that entitles its holder to a specific limited use or enjoyment; "

or

"

easement

A right to use another person's real estate for a specific purpose. The most common type of easement is the right to travel over another person's land, known as a right of way. In addition, property owners commonly grant easements for the placement of utility poles, utility trenches, water lines or sewer lines. The owner of property that is subject to an easement is said to be "burdened" with the easement, because he or she is not allowed to interfere with its use. For example, if the deed to John's property permits Sue to travel across John's main road to reach her own home, John cannot do anything to block the road. On the other hand, Sue cannot do anything that exceeds the scope of her easement, such as widening the roadway. "

I was thinking of it as public domain - which goes hand in hand with the theme of the song

No, but I have an asshole neighbor across the street that went ballistic when I tried to put a mailbox on the edge of his EASEMENT where the post office said I needed to to get mail ( they won't deliver on my side of the road ). Of course I didn't want to get my mail stolen so I forgot it. Fortunately the neighbor on the other side is normal.

Sucks to have crappy neighbors. As you know, it's just better to stay clear sometimes than fight!
